WHS Disputes

From 1 September 2024, pursuant to Part 5, Division 7A of the WHS Act, new dispute resolution provisions facilitate timely resolution of WHS disputes with a conciliation, mediation and arbitration model.

Certain parties may initiate SAET’s involvement in a WHS dispute, by completing and lodging an A54 application form.

If the dispute is urgent the applicant should lodge the application on the forms page and telephone the Registry, for an afterhours urgent dispute also contact the Registry number.

Other WHS Applications

Other WHS applications  include an application for disqualification of a health and safety representative, and applications for review about:

  • failure to commence negotiations
  • training of a health and safety representative
  • a health and safety committee
  • a provisional improvement notice
  • forfeiture of thing
  • return of seized things
  • an improvement notice
  • an extension of time for compliance with improvement notice
  • the issue of a prohibition notice
  • the issue of a non-disturbance notice
  • the issue of subsequent notice
  • a decision of a regulator to vary or cancel notice
  • contravention of certain orders relating to arbitrations.
