Ex parte applications – new process and online form

SAET is changing how it handles ex parte applications for directions.
What is an ex parte application?
An application by one party on the case, to be heard and determined in the absence of the other party or parties, is called an “ex parte” application.
What is changing?
To ensure all ex parte material remains confidential and restricted to the lodging party, from 12 March 2026:
- A new form P05a – Ex parte Application for Directions has been created
- Ex parte applications will be allocated a new SAET case number, separate to the existing case. This ex parte case number should be quoted when corresponding with SAET about the ex parte application.
- The party lodging the ex parte application will be the only party to that case.
- Ex parte cases will not be identifiable on the SAET website case lists.
New online form
The new form P05a should be used for all ex parte applications for directions.
Go to SAET Forms – SAET and select:
- P05a – Ex parte Application for Directions
- P03 – Affidavit (Word) – a supporting affidavit is required
Benefits of the new online form include:
- Filing of the application will create a new case number where the lodging party is the singular party to the ex parte case, to ensure all ex parte material remains confidential and restricted to the ex parte case.
- User friendly access to submit the form directly from your computer, tablet or phone.
- You will receive a PDF copy of the completed form for your records.
- Quicker processing by SAET.
