South Australian Employment Tribunal Rules 2024

On 28 November 2024, the South Australian Employment Tribunal Rules 2024 were gazetted and took immediate effect, revoking the 2022 Rules.
Following a comprehensive review and extensive stakeholder consultation, the Rules have been revised to reflect legislative amendments which took effect on 1 December 2024 flowing from the Statutes Amendment (South Australian Employment Tribunal) Act 2024 (gazetted on 31 October 2024), the Return to Work (Employment and Progressive Injuries) Amendment Act 2024, (gazetted on 28 November 2024). Amendments made earlier to give effect to changes to the Work Health and Safety Act 2012 (gazetted on 22 August 2024 and commencing on 1 September 2024) remain.
The review of the 2022 Rules incorporate broader changes to the Rules in keeping with their overall purpose to facilitate the objects of the South Australian Employment Tribunal Act 2014, including the just, timely and cost-effective resolution of real issues in proceedings.
As result of these changes the following new forms have been introduced and can be accessed from the SAET Forms page:
- A06 – Application for Payment of Wages (section 19, Return to Work Act 2014)
- A24 – Application for Pre-Action Discovery (rule 59, South Australian Employment Tribunal Rules 2024)
- A94 – Application for Review of an Exercise of Administrative Power by a Registrar (section 72, South Australian Employment Tribunal Act 2014)
- P04 – Reply (rule 24, South Australian Employment Tribunal Rules 2024)
